By accessing or using KinVisuals.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
We reserve the right to update or modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We will notify you of significant changes via email or through the Service.
Account Terms
- You must be at least 13 years old to use the Service.
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account and password.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
- One person or legal entity may maintain no more than one free account.
User Responsibilities
When using KinVisuals.com, you agree to:
- Use the Service only for lawful purposes and in accordance with these Terms.
- Not upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
- Not attempt to gain unauthorized access to other users' accounts or data.
- Not use the Service to transmit viruses, malware, or other harmful code.
- Not interfere with or disrupt the Service or servers connected to the Service.
- Respect the privacy and data of other family members you invite to your tree.
- Ensure you have the right to upload any photos or content you add to the Service.
Your Content
You retain ownership of all content you upload to KinVisuals.com, including family data, photos, biographies, and other materials ("Your Content").
By uploading content, you grant us a limited license to store, display, and process Your Content solely for the purpose of providing the Service to you. We will not use Your Content for any other purpose without your explicit consent.
You can export or delete Your Content at any time. Upon account deletion, we will remove Your Content within 30 days, except where retention is required by law.
Intellectual Property
The Service, including its original content (excluding Your Content), features, and functionality, is owned by KinVisuals.com and is protected by international copyright, trademark, and other intellectual property laws.
Our name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of KinVisuals.com. You may not use such marks without our prior written permission.
Payment Terms
Subscriptions: Paid features are billed on a recurring basis (monthly or as a one-time lifetime purchase). You will be billed in advance on a recurring basis.
Free Trial: We may offer a free trial with limited features. The trial allows up to 3 family members without requiring payment.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period.
Refunds: Monthly subscriptions are non-refundable. Lifetime purchases may be refunded within 14 days of purchase if you have not used the Service extensively.
Payment Processing: All payments are processed securely through Stripe. We do not store your credit card information.
Sharing & Collaboration
KinVisuals.com allows you to invite others to view or collaborate on your family tree. When you share access:
- You are responsible for managing who has access to your tree.
- Invited collaborators can view and, if permitted, edit your family tree data.
- You can revoke access at any time.
- We are not responsible for actions taken by collaborators you have invited.
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms. Upon termination:
- Your right to use the Service will immediately cease.
- We will provide a reasonable opportunity to export your data before deletion.
- Your data will be deleted within 30 days of account termination.
You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
Limitation of Liability
To the maximum extent permitted by law, KinVisuals.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We make no warranties about the accuracy or reliability of any content obtained through the Service.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
